Common questions
I bought from a private seller, not a dealer. Can I still claim?
Yes. If the seller misrepresented the car — lied about mileage, hid damage, or described it as something it wasn’t — you can claim for misrepresentation. Private sellers must describe goods accurately.
The dealer says “sold as seen”. Does that protect them?
No. Under the Consumer Rights Act 2015, goods sold by a trader must be of satisfactory quality, fit for purpose, and as described. “Sold as seen” notices don’t override your statutory rights.
My car broke down after 3 months. Is it too late?
No. You have up to 6 months to request a repair or replacement from a dealer. After 6 months you can still claim, but you may need to show the fault was present at the time of sale (an independent inspection helps).
The mechanic made things worse. What can I claim?
You can claim the cost of putting things right — the repair bill to fix their mistake, plus any consequential losses like hire car costs or recovery fees.
Do I need an independent inspection report?
It helps but isn’t essential for small claims. Photos, the original advert, MOT history, and your description of the faults are often enough. The court uses a “balance of probabilities” standard, not “beyond reasonable doubt”.
