These Terms and Conditions (“Terms”) govern your use of the JustClaim platform (“the Service”), operated by JustClaim (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use the Service.

Important: JustClaim is not a law firm, does not provide legal advice, and is not a substitute for qualified legal counsel. If you are uncertain about the merits of your claim or the legal implications of any document, you should consult a solicitor or other qualified legal professional before proceeding.

1. Nature of the Service

1.1. JustClaim provides a technology platform that assists users in preparing their own legal documents, including but not limited to letters before action, pre-action protocol correspondence, N1 claim forms, particulars of claim, witness statements, and other court forms required for civil proceedings in the County Court of England and Wales.

1.2. The Service utilises artificial intelligence and automated systems to help users draft documents based on information provided by the user. All documents generated by the Service are drafts prepared on the user’s behalf and at the user’s direction. The user is the author of all documents produced.

1.3. Where JustClaim facilitates the sending of correspondence (including letters before action or pre-action protocol letters) to third parties, JustClaim acts solely as a postal and communications conduit. JustClaim transmits documents prepared by the user to the intended recipient on the user’s instructions. The content of such correspondence is determined entirely by the user, and JustClaim bears no responsibility for the substance, accuracy, or legal effect of any document transmitted.

1.4. JustClaim does not file documents with HM Courts and Tribunals Service (HMCTS) on the user’s behalf. Where the Service generates court forms, these are provided to the user for self-filing by the user through the appropriate court channels (including Money Claim Online or by post to the relevant County Court hearing centre).

In summary: JustClaim helps you prepare your own documents and, where instructed, posts correspondence on your behalf. We are a document preparation and postal conduit service, not a legal practice. You are a litigant in person and remain responsible for your own case at all times.

2. No Legal Advice

2.1. Nothing provided by the Service, including any AI-generated text, document templates, guidance notes, informational content, or correspondence, constitutes legal advice within the meaning of the Legal Services Act 2007 or otherwise.

2.2. JustClaim is not regulated by the Solicitors Regulation Authority (SRA), the Bar Standards Board (BSB), or any other legal services regulator. No solicitor-client relationship, barrister-client relationship, or other professional retainer is created by use of the Service.

2.3. The informational content provided on the JustClaim website and within the Service (including guides, articles, and general explanations of court procedures) is provided for general informational purposes only. Whilst we endeavour to ensure that such information is accurate and up to date, we make no representation or warranty, express or implied, as to its completeness, accuracy, reliability, or suitability for any particular purpose.

2.4. You acknowledge that the law is complex and subject to change, and that general information cannot account for the specific circumstances of your case. If you are in any doubt as to the merits of your claim, the legal basis for your cause of action, the appropriate quantum of damages, limitation periods, or any other aspect of your dispute, you should seek independent legal advice from a solicitor or other qualified legal professional before using the Service or commencing proceedings.

3. User Responsibilities

3.1. You are solely responsible for the accuracy and completeness of all information you provide to the Service. JustClaim generates documents based on the facts and instructions you supply. If the information you provide is inaccurate, incomplete, or misleading, the resulting documents may be defective, and any claim or correspondence based upon them may fail or cause prejudice to your case.

3.2. You are solely responsible for reviewing, verifying, and approving all documents generated by the Service before they are sent, filed, or otherwise used. You must satisfy yourself that the content of every document is true, accurate, and complete before authorising its use. Court documents, including the N1 claim form and particulars of claim, contain a statement of truth which you sign. Making a false statement in a document verified by a statement of truth may constitute contempt of court under Part 22 of the Civil Procedure Rules.

3.3. You are responsible for ensuring that your claim is brought within the applicable limitation period. JustClaim does not monitor or advise on limitation periods, and the expiry of a limitation period may bar your claim entirely.

3.4. You are responsible for complying with all applicable pre-action protocols, practice directions, and procedural requirements of the Civil Procedure Rules. Whilst the Service is designed to assist with compliance, it is your responsibility to ensure that all procedural obligations are met.

3.5. You must not use the Service to prepare fraudulent, vexatious, or abusive claims, or to harass, intimidate, or threaten any person. You must not submit knowingly false information or use the Service for any purpose that is unlawful or contrary to these Terms.

3.6. Where the Service is used to send correspondence to a third party, you confirm that you have a genuine and legitimate basis for the claim or demand contained in that correspondence. You acknowledge that sending demands without reasonable grounds may give rise to liability on your part.

4. AI-Generated Content

4.1. The Service uses artificial intelligence to assist in drafting documents. AI-generated content is produced algorithmically based on the information you provide and general legal templates. AI systems may produce errors, omissions, or content that is not appropriate for your specific circumstances.

4.2. You acknowledge and agree that AI-generated content is a starting point and must be reviewed, edited, and verified by you before use. JustClaim does not warrant that AI-generated content is legally correct, complete, or fit for any particular purpose.

4.3. You acknowledge that AI-generated particulars of claim, witness statements, and other legal documents may require amendment to accurately reflect the facts of your case. Submitting inaccurate documents to the court may result in your claim being struck out, adverse costs orders, or other sanctions.

4.4. JustClaim does not guarantee any particular outcome from the use of AI-generated documents. The success or failure of your claim depends on the merits of your case, the evidence available, and the decisions of the court.

4.5. Third-party AI models. The Service utilises large language models (“LLMs”) developed and operated by third-party providers. JustClaim does not develop, train, fine-tune, or otherwise control the underlying AI models used by the Service. The behaviour, outputs, and capabilities of these models are determined by their respective providers. JustClaim makes no representation or warranty as to the accuracy, reliability, or consistency of outputs produced by third-party AI models and accepts no liability for errors, omissions, or hallucinations generated by such models.

4.6. Use at own risk. Your use of AI-generated features within the Service is entirely at your own risk. AI models may produce outputs that are factually incorrect, legally inapplicable, internally inconsistent, or otherwise unsuitable for use in court proceedings. You are solely responsible for critically evaluating all AI-generated content and satisfying yourself as to its accuracy and appropriateness before relying upon it. JustClaim expressly disclaims all warranties, whether express, implied, or statutory, in respect of AI-generated outputs, including any implied warranties of satisfactory quality, fitness for a particular purpose, or reasonable care and skill, to the fullest extent permitted by applicable law.

4.7. No training on user data. JustClaim does not use the information you provide, the documents generated for you, or any other user data to train, fine-tune, or improve AI models. Your data is processed solely for the purpose of providing the Service to you in accordance with our Privacy Policy. However, third-party AI providers may process data in accordance with their own terms and policies, and JustClaim’s ability to control such processing is limited to the contractual arrangements in place with those providers.

5. Limitation of Liability

5.1. Statutory rights preserved. Nothing in these Terms excludes or limits JustClaim’s liability for: (a) death or personal injury caused by JustClaim’s negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or (d) any other liability which cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977. Your statutory rights as a consumer are not affected by these Terms.

5.2. Nature of the Service and reasonable expectations. You acknowledge that JustClaim is a document preparation and postal conduit service, not a firm of solicitors. The Service assists you in drafting your own documents based on information you provide. You retain full editorial control over all documents before they are used. Given the nature of the Service and the price at which it is offered, you agree that the limitations set out in this section 5 represent a reasonable allocation of risk between you and JustClaim within the meaning of section 11 of the Unfair Contract Terms Act 1977 and the relevant provisions of the Consumer Rights Act 2015.

5.3. Exclusion of indirect and consequential loss. Subject to clause 5.1, JustClaim shall not be liable to you (whether in contract, tort including negligence, breach of statutory duty, misrepresentation, restitution, or otherwise) for any indirect, special, or consequential loss or damage, including but not limited to: loss of profit, loss of goodwill, loss of business opportunity, loss of anticipated savings, wasted expenditure, or loss arising from adverse costs orders, court sanctions, or the outcome of any legal proceedings, howsoever arising and whether or not such loss was foreseeable or JustClaim had been advised of its possibility.

5.4. Exclusion of liability for document content. Subject to clause 5.1, JustClaim excludes all liability in respect of the accuracy, completeness, legal sufficiency, or fitness for purpose of any document generated by the Service, any AI-generated content, any informational content or guidance published on the JustClaim website, and the delivery, non-delivery, or delayed delivery of any correspondence transmitted through the Service. You accept full responsibility for reviewing, verifying, and approving all documents before use.

5.5. Maximum liability cap. Subject to clause 5.1, JustClaim’s total aggregate liability to you in respect of all claims arising out of or in connection with the Service (whether in contract, tort, negligence, breach of statutory duty, or otherwise) shall not exceed the JustClaim service fee actually paid by you for the specific transaction giving rise to the claim. For the avoidance of doubt, this cap does not include court filing fees, hearing fees, or any other sums payable to HM Courts and Tribunals Service, which are not fees paid to JustClaim.

5.6. Severability and fallback cap. Each sub-clause of this section 5 is severable. In the event that any provision of this section 5 (or any part thereof) is found by a court of competent jurisdiction to be invalid, unenforceable, or void under the Unfair Contract Terms Act 1977, the Consumer Rights Act 2015, or otherwise, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed. The remaining provisions shall continue in full force and effect. In any such event, JustClaim’s maximum aggregate liability shall not exceed the JustClaim service fee paid by you for the transaction in question, and this limitation shall apply to the fullest extent permitted by applicable law.

5.7. Reasonableness. You acknowledge that: (a) the Service is provided at a modest price relative to the value of the claims it assists with; (b) you are responsible for the factual content of your documents and for deciding whether to proceed with litigation; (c) the Service expressly recommends that you seek independent legal advice if you are in any doubt; and (d) it would not be commercially viable for JustClaim to offer the Service at its current price without the limitations set out in this section 5. Accordingly, you agree that these limitations are fair and reasonable in all the circumstances.

Key point: You are a litigant in person. JustClaim assists you in preparing your own documents, but you bear full responsibility for the content of your submissions to the court and to third parties. JustClaim’s maximum liability is limited to the service fee you paid. If you are unsure about any aspect of your claim, seek independent legal advice before proceeding.

6. Fees and Payment

6.1. Certain features of the Service are provided free of charge, including general informational content, guides, and the court fee calculator. Other features, including document generation and postal delivery of correspondence, may be subject to fees as displayed at the point of purchase.

6.2. All fees are inclusive of VAT where applicable and are payable in pounds sterling (GBP). Payment is processed securely through our third-party payment provider (Stripe). JustClaim does not store your payment card details.

6.3. Fees paid for document generation are non-refundable once the documents have been generated and made available to you, except where required by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may exercise your right to cancel within 14 days of purchase, provided that the digital content has not yet been delivered and you have not expressly consented to waive your cancellation rights.

6.4. JustClaim fees are separate from and do not include court filing fees, hearing fees, or any other fees payable to HM Courts and Tribunals Service. You are responsible for paying all court fees directly.

7. Intellectual Property

7.1. All intellectual property rights in the Service, including its software, design, functionality, templates, and branding, are owned by JustClaim or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2. Documents generated for you through the Service are yours to use for the purpose of pursuing or defending your civil claim. You may not resell, sublicense, or commercially distribute documents generated by the Service.

7.3. You grant JustClaim a non-exclusive, royalty-free licence to use anonymised and aggregated data derived from use of the Service for the purposes of improving the Service, conducting research, and developing new features. No personally identifiable information will be used for these purposes without your consent.

8. Prohibited Use

You must not use the Service to:

  • prepare or send fraudulent, vexatious, or knowingly false claims or correspondence;
  • harass, threaten, defame, or intimidate any person;
  • circumvent court rules, pre-action protocols, or other legal requirements;
  • send correspondence that constitutes blackmail, extortion, or an unlawful demand;
  • impersonate another person or misrepresent your identity or authority;
  • reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service;
  • use automated systems, bots, or scripts to access the Service in a manner that could damage, disable, or impair the Service.

We reserve the right to suspend or terminate your access to the Service immediately and without notice if we reasonably believe you are in breach of these provisions.

9. Third-Party Services

9.1. The Service integrates with third-party providers, including payment processors (Stripe), hosting providers, and AI model providers (Anthropic). Your use of these third-party services is subject to their respective terms and conditions and privacy policies.

9.2. JustClaim is not responsible for the availability, performance, or conduct of third-party services. In the event of a failure or interruption of a third-party service, JustClaim’s liability is limited to making reasonable efforts to restore the affected functionality.

9.3. Links to external websites (including government websites, court services, and legal resources) are provided for convenience only. JustClaim does not endorse or accept responsibility for the content of external websites.

10. Termination

10.1. You may stop using the Service at any time. If you wish to delete your data, please contact us (see section 12 below) or refer to our Privacy Policy.

10.2. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. In particular, we may terminate access if we reasonably believe you are in breach of these Terms or using the Service for any prohibited purpose.

10.3. Upon termination, these Terms shall cease to apply, except that sections 2 (No Legal Advice), 3 (User Responsibilities), 4 (AI-Generated Content), 5 (Limitation of Liability), and 7 (Intellectual Property) shall survive termination and continue to bind both parties.

11. Governing Law and Jurisdiction

11.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.

11.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11.3. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
